uh walley I'd recommend definitely legally forming your business. Let alone the tax benefits...if it's not worth writing up a formal business plan, reviewing with counsel and forming an appropriate entity for your business, it's not worth doing at all. You ask this question because you haven't written a thorough business plan. The time to answer all these questions is up front.
